1. Acceptance of Terms

By accessing or using NorvaCreate ("the Service"), operated by NorvaLabs ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.

2. Description of Service

NorvaCreate is an AI-powered e-commerce content generation platform that enables users to:

• Upload product images for AI analysis
• Generate professional product photography, lifestyle images, ad creatives, social media content, and videos
• Manage product catalogs and generated assets
• Download and use generated content for commercial purposes

3. Account Registration

To use NorvaCreate, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You must be at least 13 years of age (or 16 in the EEA) to create an account. By creating an account, you represent that you meet this requirement.

4. Credits and Billing

Credit System

NorvaCreate operates on a credit-based system. Each generation type consumes a specified number of credits. Credit costs are displayed before each generation and on our pricing page.

Subscriptions

• Subscription plans are billed monthly or annually as selected at purchase
• Monthly credit allowances reset at the start of each billing cycle
• Unused credits do not roll over to the next billing period unless explicitly stated
• You may upgrade or downgrade your plan at any time; changes take effect at the next billing cycle

Credit Packs

One-time credit pack purchases are non-refundable and do not expire while your account remains active.

Refunds

Subscription fees are generally non-refundable. If you experience a technical issue that prevents content generation after credits are deducted, please contact us for a credit refund within 7 days of the issue.

5. Content Ownership and Licenses

Your Content

You retain all ownership rights to the product images and other content you upload to NorvaCreate. By uploading content, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service.

Generated Content

AI-generated content (images, videos, and other outputs) created through NorvaCreate is owned by you. You are granted a perpetual, worldwide, royalty-free license to use generated content for any lawful purpose, including commercial use.

We do not claim any ownership over your generated content. However, generated content is produced by AI models and may not be eligible for copyright protection in all jurisdictions. You are responsible for understanding the intellectual property laws applicable to your use.

Restrictions

You may not use generated content to:

• Create misleading or deceptive materials
• Generate content that infringes on third-party intellectual property rights
• Produce illegal, harmful, or offensive material
• Impersonate any person or entity

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that you do not have the right to use
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Interfere with or disrupt the Service or its infrastructure
• Use automated scripts or bots to access the Service without authorization
• Resell or redistribute the Service or access to it
• Share account credentials with third parties
• Upload malicious files, viruses, or harmful code

We reserve the right to suspend or terminate accounts that violate these terms, at our sole discretion, without prior notice or refund.

7. AI-Generated Content Disclaimer

Content generated by NorvaCreate is produced using artificial intelligence and may not always be accurate, appropriate, or suitable for your intended use. You are solely responsible for reviewing all generated content before use.

AI-generated content may occasionally:

• Contain visual artifacts or imperfections
• Not perfectly match the style or quality you expect
• Produce results that vary between generations

We continuously work to improve output quality but do not guarantee that all generated content will meet specific standards.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to provide notice of significant changes.

9. Limitation of Liability

To the maximum extent permitted by law, NorvaCreate and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify and hold harmless NorvaCreate, its operators, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

12. Termination

You may terminate your account at any time by contacting us or through your account settings. Upon termination:

• Your access to the Service will be revoked
• Remaining credits are forfeited and non-refundable
• Your data will be deleted within 30 days per our Privacy Policy
• Any active subscriptions will be cancelled

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NorvaLabs operates, without regard to its conflict of law provisions.
